Please read these Terms of Service carefully before using dkai.co.uk. By accessing or purchasing from our website, you agree to be bound by these terms in their entirety. If you do not agree, please do not use the site.

1. About Us

DKAI UK LTD ("DKAI London", "we", "us", "our") is the operator and seller of goods purchased through dkai.co.uk. DKAI UK LTD is a company registered in England and Wales (Companies House No. 16691324), with its registered office at 4-6 Greatorex Street, London E1 5NF, United Kingdom.

2. Acceptance of Terms & B2C Scope

By using our website and placing an order, you confirm that you are at least 18 years of age (or have parental consent), are a resident of the United Kingdom or a permitted territory, and agree to be bound by these Terms of Service, our Privacy Policy, Refund Policy and Shipping Policy.

Our website is intended for personal, non-commercial use by consumers only. Purchases for resale, commercial redistribution or any business purpose are not permitted unless agreed in writing in advance. We reserve the right to cancel any order suspected to be for resale or commercial purposes.

3. Products and Pricing

We reserve the right to modify, withdraw or discontinue any product at any time without notice. All prices are displayed in British Pounds Sterling (GBP) and include applicable VAT where required. Prices are subject to change without notice. In the event of a pricing error, we reserve the right to cancel the affected order and issue a full refund — we are not obliged to fulfil orders at incorrect prices.

4. Orders and Contract

When you place an order, you make an offer to purchase the items listed. A legally binding contract is formed only when we send you an order confirmation email. We reserve the right to refuse, cancel, limit quantity or reject any order at our sole discretion, including in cases of suspected fraud, pricing errors, stock unavailability, delivery restrictions, or any other reason. If we cancel your order after payment has been taken, a full refund will be issued promptly.

5. Payment

We accept payment via the methods displayed at checkout. All transactions are processed securely. By submitting a payment, you confirm that the payment details provided are yours (or you are authorised to use them) and that you have sufficient funds.

We use Shopify Payments and other PCI-DSS compliant processors. We do not store full card details. Use of stolen, unauthorised or fraudulent payment methods is a criminal offence and will be reported to the relevant authorities.

6. Delivery

Estimated delivery times are provided at checkout and in our Shipping Policy. These are estimates only and not guaranteed. We are not liable for delays caused by circumstances outside our control. Risk of loss and title for items passes to you upon delivery. Please refer to our Shipping Policy for full details.

7. Promotions and Discount Codes

Promotional codes and discounts are subject to their specific terms. They cannot be combined unless stated otherwise, have no cash value, and are non-transferable. Discount codes are for single, one-time use per account/customer/household unless stated otherwise. We reserve the right to withdraw, modify or invalidate any promotion at any time, and to cancel orders abusing promotional terms (including but not limited to multiple accounts, fraudulent referrals, or stacking unauthorised codes).

8. Intellectual Property

All content on this website — including text, images, logos, product names, design and source code — is the intellectual property of DKAI UK LTD or its licensors and is protected by UK and international copyright laws. You may not reproduce, distribute, scrape, frame, mirror, modify, sell, or commercially exploit any content without our prior written consent. Unauthorised use may result in legal action and a claim for damages.

9. User Conduct

When using our website, you agree not to:

  • Submit false, misleading or fraudulent information
  • Use the site for any unlawful purpose
  • Attempt to gain unauthorised access to our systems
  • Interfere with the operation of the website
  • Use automated tools (bots, scrapers, crawlers) to extract data or place orders
  • Submit defamatory, abusive, threatening or offensive reviews or messages
  • Use our brand name, images or content for resale, comparison advertising or counterfeit operations

10. Limitation of Liability

To the fullest extent permitted by law:

  • DKAI UK LTD shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages arising from your use of our website or products, including but not limited to loss of profit, revenue, data, goodwill, business opportunity, anticipated savings, or any third-party costs;
  • Our total aggregate liability to you for any and all claims arising from or relating to a transaction shall not exceed the price paid for the relevant product(s), excluding any shipping or related charges;
  • We are not liable for any allergic reaction, skin sensitivity or adverse health response caused by the use of any product — care labels and material composition are displayed on each product page and you are responsible for reviewing them prior to purchase.

Nothing in this clause limits our liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any liability that cannot be excluded under UK law.

11. Product Photographs & Variations Disclaimer

Product photographs are for illustrative purposes only. Actual products may show slight variations in colour, pattern placement, fabric texture, weight, weave or finish due to natural fabric characteristics, screen calibration, lighting and batch production. Garment measurements may vary by approximately ±2cm due to manufacturing tolerances. Such variations are normal, do not constitute a defect, and are not grounds for refund or replacement.

12. Disclaimer of Warranties

Our website and products are provided "as is" and "as available". While we strive for accuracy, we do not warrant that product descriptions, prices, availability or other content on the site are error-free, complete or current. We reserve the right to correct any errors and update content without notice.

13. Dispute Resolution & ADR

If you have a dispute with us, please contact us first at contact@dkai.co.uk. We are committed to resolving disputes amicably and will respond within 14 business days.

If we are unable to resolve the dispute through direct communication, you may be entitled to refer the dispute to an approved Alternative Dispute Resolution (ADR) provider in the UK before commencing court proceedings. Information on ADR is available via the UK Government Trading Standards portal and the European Online Dispute Resolution platform (where applicable).

This clause does not affect your statutory right to bring proceedings before a court.

14. Consumer Rights

Nothing in these Terms affects your statutory rights as a consumer under UK law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. UK consumers have a 14-day statutory right to cancel most orders from the date of delivery without giving a reason (subject to excluded items). Please see our Refund Policy for details.

15. Governing Law and Jurisdiction

These Terms of Service and any non-contractual obligations arising from them are governed by the laws of England and Wales. Any disputes arising from these terms or your use of our website shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Changes to These Terms

We may revise these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of the website following any changes constitutes your acceptance of the revised terms. We recommend reviewing this page periodically.

17. Indemnification

You agree to indemnify, defend and hold harmless DKAI UK LTD, its officers, directors, employees, contractors and suppliers from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising from or relating to: (a) your breach of these Terms; (b) your misuse of our website or products; (c) your violation of any law or third-party rights; (d) any false or inaccurate information you provide; or (e) any claim by a third party arising from your use of our products or website.

18. Chargebacks & Payment Disputes

Before initiating a chargeback or payment dispute with your bank, you are required to contact us first at contact@dkai.co.uk and allow us a reasonable opportunity (no less than 14 calendar days) to resolve the issue. We respond to all enquiries within 24 hours (Mon-Fri).

Chargebacks initiated without prior contact, or in circumstances we believe to be abusive or fraudulent, may result in:

  • A chargeback administration fee of £25 per disputed transaction charged to the customer;
  • Termination of your account and prohibition from future purchases;
  • Referral to a debt collection agency or legal action to recover funds and associated fees;
  • Reporting to fraud prevention databases.

We retain detailed records (order confirmation, dispatch tracking, delivery proof, communication history) and routinely defend illegitimate chargebacks with full evidence.

19. Anti-Fraud & Order Verification

We reserve the right, at our sole discretion, to verify the identity of any customer, request additional documentation (such as proof of identity or proof of address) before processing or dispatching an order, delay or refuse processing of any order, or cancel any order that we believe to be fraudulent, suspicious or in breach of these Terms. Funds taken from a cancelled order will be refunded in full.

20. Force Majeure

We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic-related disruptions, war, terrorism, civil unrest, government restrictions or sanctions, cyber-attacks or data breaches affecting third-party providers, postal or carrier strikes, fuel shortages, supplier failure, port congestion, customs delays, or any other force majeure event.

21. Right to Refuse Service

We reserve the right to refuse service, terminate accounts, cancel orders, remove or edit content, in our sole discretion, including for any breach of these Terms or for any other reason permitted by law.

22. Entire Agreement

These Terms of Service, together with our Privacy Policy, Refund Policy and Shipping Policy, constitute the entire agreement between you and DKAI UK LTD regarding the use of our website and the purchase of our products, superseding any prior agreements or communications.

23. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver shall be effective unless in writing and signed by an authorised representative of DKAI UK LTD.

24. Severability

If any provision of these Terms is found to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision shall be severed from these Terms and the remaining provisions shall continue in full force and effect.

25. Notices

Any notice to be given under these Terms shall be delivered by email to contact@dkai.co.uk (for notices to us) or to the email address provided at checkout (for notices to you). Email is deemed to be a valid and sufficient form of written notice for the purposes of these Terms.

26. Assignment

We may assign or transfer our rights and obligations under these Terms at any time without notice. You may not assign or transfer your rights or obligations without our prior written consent.
